The Gauteng High Court suspended the declaration of invalidity of the regulations for 14 days, meaning that the level 3 regulations remain in effect for now. The court has government to amend, review, and republish the regulations. This must be done with due consideration to the limitation each regulation has on the rights guaranteed under the Bill of Rights. Siphosihle Mbuli speaks to Tanveer Jeewa, Researcher at the African Legal Information Institute to understand the implications of the ruling. Jeewa says she does not agree with the judgement adding that the judgement is a rationality test instead of a an analysis of Section 36 of the Constitution.
